What to Expect When You’re Facing Charges
What should I do if I’ve been arrested or charged?
Stay calm and use your right to remain silent. You have the right to speak with a lawyer without delay, and police must give you the chance to do so. Avoid discussing your case with anyone, including on social media. If you’re released with conditions, follow them carefully, since breaching them is a separate criminal offence.
What happens at my first court appearance?
Your first appearance is usually brief. The charges are confirmed, and the Crown begins sharing its evidence against you, known as disclosure. You generally aren’t expected to enter a plea that day, which gives your lawyer time to review the evidence first. Your lawyer can often appear on your behalf, but never simply miss a court date.
What is a peace bond, and does it give me a criminal record?
A peace bond is a court order requiring a person to keep the peace and follow certain conditions, such as staying away from someone, usually for up to 12 months. It isn’t a conviction and doesn’t result in a criminal record.
In some cases, the Crown agrees to withdraw a charge in exchange for a peace bond. Breaching its conditions, however, is a criminal offence.
What is the Nova Scotia Wellness Court?
The Nova Scotia Wellness Court is a program for people whose charges are connected to mental health or substance use issues. Instead of following the usual court process, participants complete a treatment plan supervised by the court, which can lead to a lighter sentence.
Entering the program generally requires accepting responsibility for the offence, so speak with a lawyer before applying.
